Legal Documents GDPR Information Obligation

Dear Customers, As of 25 May 2018, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (commonly known as "GDPR") has been in effect. The GDPR applies uniformly across all European Union member states, including Poland, and introduces a number of changes to the rules governing the processing of personal data. We hereby inform you that:

  1. The controller of your personal data is: FHU Stanisław Frejus, registered at Siedlisko 13, 64-980 Trzcianka, Poland, Tax ID (NIP): 7631785741.

  3. Your personal data will be processed for the purpose of fulfilling the sales agreement, pursuant to Art. 6(1)(b) of the GDPR.
  4. Recipients of your personal data will be exclusively entities authorised to obtain personal data under applicable law and entities involved in the provision of services.
  5. Your personal data will be stored for the period deemed necessary for the purpose for which it was collected (including in accordance with applicable laws and regulations). Personal data may be stored longer where required by law or for the purpose of establishing, exercising or defending the controller's rights.
  6. You have the right to request access to your personal data, the right to rectification, erasure, restriction of processing and the right to data portability.
  7. You have the right to lodge a complaint with the supervisory authority.
  8. Providing personal data is voluntary; however, refusal to provide data may result in the inability to provide the service/fulfil the agreement.

TERMS AND CONDITIONS OF THE FREJUS ONLINE STORE – HYDRAULIC POWER

Effective date: 19 December 2025

§ 1. General Provisions

  1. These Terms and Conditions (hereinafter: "Terms") define the rules for using the online store operated by FHU Stanisław Frejus, Tax ID (NIP): 7631785741, REGON: 970586687, registered at Siedlisko 13, 64-980 Trzcianka, Poland (hereinafter: "Seller").
  2. The Store operates on the PrestaShop platform and enables the purchase of hydraulic power products and other technical goods.
  3. These Terms constitute an integral part of the sales agreement concluded with the Customer and are available free of charge on the Store's website.
  4. The Seller reserves the right to amend these Terms for important reasons, in particular to comply with applicable legislation.

§ 2. Definitions

  1. "Customer" – a natural person who has reached the age of 18 and has full legal capacity, as well as a legal entity or organisational unit without legal personality, using the Store, including any person placing an Order.
  2. "Consumer" – a natural person entering into a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
  3. "Entrepreneur" – a natural person, legal entity or organisational unit without legal personality conducting business or professional activity in their own name.
  4. "Goods" – movable items offered for sale in the Store, including hydraulic power components, equipment and accessories.
  5. "Payment operator" – an entity providing online payment services. Payments (fast transfers, BLIK, cards) are processed by Autopay S.A., registered in Sopot, entered in the National Court Register under KRS 0000320590.

§ 4. Technical Requirements

  1. The Store is available in Polish and accepts payments in PLN (Polish zloty), as required by the Autopay payment gateway.
  2. Use of the Store requires a computer or mobile device with internet access, an up-to-date web browser and acceptance of cookies.
  3. An active email account is required to place orders.
  4. The Store uses cookies for functionality, analytics and marketing purposes. Details can be found in the Privacy Policy.

§ 5. Placing Orders

  1. Orders can be placed 24 hours a day via the order form in the Store.
  2. Order procedure: the Customer selects goods, adds them to the cart, fills in the required information and accepts the Terms.
  3. Placing an order constitutes the conclusion of a sales agreement between the Customer and the Seller upon confirmation of the order by the Seller.
  4. The Customer is obliged to provide accurate data. The Seller is not responsible for providing false or incomplete data.
  5. The Seller does not automatically add any additional paid products.

§ 6. Prices and Payment Methods (Autopay)

  1. All prices in the Store are gross prices (including VAT) and are expressed in Polish zloty (PLN).
  2. The price shown at the time of placing an order is binding. Delivery costs are added in accordance with the price list visible in the cart.
  3. Available payment methods: a) Online payments (Autopay): fast transfers, BLIK, payment cards (Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro) and instalments. Processed by Autopay S.A. No additional fees for card payments. b) Traditional bank transfer: to the Seller's bank account. The Customer has 3 business days to make the payment. c) Cash on delivery: cash or card payment upon receipt (if available).
  4. For prepayment orders, processing begins upon receipt of positive payment authorisation or funds being credited.
  5. Card refunds: Refunds for card transactions will be made to the bank account linked to the payment card used.
  6. The Seller confirms that the Store's product range does not include categories prohibited by the payment operator (e.g. alcohol, weapons).

§ 7. Delivery

  1. Delivery is carried out within the territory of the Republic of Poland by courier companies: DPD, FedEx, InPost Parcel Lockers (and other carriers available in the Store).
  2. The delivery time is usually 1-5 business days from the date of positive payment authorisation.
  3. The risk of accidental loss or damage passes to the Customer upon delivery (for Consumers) or upon handover to the courier (for Entrepreneurs).

§ 8. Withdrawal from the Agreement (Consumer Returns)

  1. A Customer who is a Consumer or an Entrepreneur with consumer rights may withdraw from the distance contract within 14 days without giving a reason.
  2. To meet the deadline, it is sufficient to send the withdrawal statement before its expiry (e.g. by email to biuro@frejus.com.pl).
  3. The Seller shall refund the payment using the same method used by the Customer, unless the Customer has expressly agreed to a different method.
  4. The Customer bears the direct costs of returning the goods.
  5. Exclusions from the right of withdrawal: In accordance with Art. 38 of the Consumer Rights Act, the right of withdrawal does not apply to goods made to individual order and goods delivered in sealed packaging, among others.

§ 9. Complaints and Warranty

  1. The Seller undertakes to deliver goods free from defects.
  2. The Customer may file a complaint regarding non-conformity of the goods with the agreement. The Seller shall consider the complaint within 14 days.
  3. Regardless of statutory rights, goods may be covered by the Seller's 12-month warranty.
  4. Warranty claims should be reported immediately upon discovery of the defect.
  5. Warranty liability does not cover defects resulting from improper installation, operation, external factors or exceeding technical parameters.

§ 10. Provisions for Entrepreneurs (B2B)

  1. The Seller's liability towards business Customers is limited to actual damages resulting from gross negligence or wilful misconduct.
  2. The Seller reserves the right to charge a restocking fee of 15% to 30% of the net value of returned goods.
  3. The Seller excludes warranty liability (rękojmia) towards Entrepreneurs.
  4. The Seller is not liable for interruptions in Store operations caused by force majeure.

§ 11. Personal Data Protection (GDPR)

  1. The controller of Customers' personal data is FHU Stanisław Frejus.
  2. Data is processed for the purpose of fulfilling the sales agreement and, with the Customer's consent, for marketing purposes.
  3. Recipients of data may include the Seller's employees, courier companies and the payment operator Autopay S.A.
  4. The Customer has the right to access, rectify, delete data and withdraw consent.
  5. Details can be found in the Privacy Policy.

§ 12. Final Provisions

  1. Polish law shall apply to matters not regulated herein.
  2. Disputes with Consumers shall be resolved by the court of general jurisdiction; disputes with Entrepreneurs shall be resolved by the court having jurisdiction over the Seller's registered office.
  3. The Customer has the option to use out-of-court complaint and redress mechanisms.

Privacy Policy and Cookies

This Privacy Policy sets out the rules for the processing and protection of personal data of users of the website operated by FHU Stanisław Frejus. In particular, it defines the principles under which personal data of users is collected, processed and secured in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR).

  2. Scope of Data Collected The Controller processes the following personal data:
  • Contact form: name, surname, email, phone (optional).
  • Analytics and marketing tools: Google Analytics (traffic analysis), Google Ads (advertising campaigns), Hotjar (behaviour analysis), Crisp (chat).
  • Newsletter: name, email (processed upon user consent).
  • Data related to website use: IP address, browser data, user activity data.
  1. Purposes and Legal Bases for Processing The Controller processes user data for the following purposes:
  • Responding to contact form enquiries: user consent (Art. 6(1)(a) GDPR).
  • Analytics and optimisation: user consent (Art. 6(1)(a) GDPR).
  • Personalised advertising: user consent (Art. 6(1)(a) GDPR).
  • Communication via Crisp chat: user consent (Art. 6(1)(a) GDPR).
  • Newsletter dispatch: user consent given via the subscription form (Art. 6(1)(a) GDPR).
  • Contract performance: in the case of purchasing products or services (Art. 6(1)(b) GDPR).
  • Fulfilment of legal obligations: e.g. tax and accounting obligations (Art. 6(1)(c) GDPR).
  1. Data Recipients User data may be shared with:
  • Employees and associates of the Controller who need access to data to perform their duties.
  • Entities supporting the Controller in providing services, such as Google, Hotjar, Crisp and MailerLite, operating on the basis of data processing agreements compliant with the GDPR.
  1. Transfer of Data to Third Countries Due to the use of tools such as Google Analytics and Hotjar, data may be transferred outside the European Economic Area (e.g. to the USA). The Controller ensures that such transfers are carried out on the basis of appropriate safeguards, such as Standard Contractual Clauses approved by the European Commission.
  2. Data Retention Period
  • Contact form: data is stored for up to one year after the end of communication.
  • Analytics and marketing tools: data is stored in accordance with Google, Hotjar or Crisp policies, or until consent is withdrawn by the user.
  • Newsletter: data is stored until consent is withdrawn by the user.
  • Data related to contract performance: data is stored for the period necessary to fulfil legal obligations, including tax and accounting obligations.
  1. User Rights Users have the right to:
  • Access data – obtain information about processed personal data (Art. 15 GDPR).
  • Rectify data – correct inaccurate data (Art. 16 GDPR).
  • Erase data – request deletion of data when no longer needed for the purposes for which it was collected (Art. 17 GDPR).
  • Restrict processing – request restriction of processing in certain cases (Art. 18 GDPR).
  • Data portability – obtain a copy of data or transfer it to another controller (Art. 20 GDPR).
  • Object – object to processing based on legitimate interest (Art. 21 GDPR).

  1. Cookies and Consent The website uses cookies for the purpose of:
  • Ensuring proper website functionality – technical and functional cookies necessary for the site to operate.
  • Traffic analysis and optimisation – analytical cookies requiring user consent.
  • Personalisation of advertising content – marketing cookies requiring user consent. Users may change their browser cookie settings or block them entirely at any time; however, this may affect the proper functioning of the website.
  1. Newsletter
  • Subscription: Users may subscribe to the newsletter by providing their details (name, email) and giving consent for processing. This data will be used exclusively for marketing purposes, i.e. sending information about news, promotions and products offered by FHU Stanisław Frejus.
  • Data controller for the newsletter: FHU Stanisław Frejus.
  • Processor: MailerLite – the tool through which newsletter campaigns are conducted. Each message contains a link allowing the user to unsubscribe.
  • Processing period: data is stored until consent is withdrawn by the user by unsubscribing from the newsletter.
  1. Changes to the Privacy Policy The Controller reserves the right to make changes to this Privacy Policy. Any changes will be published on this page. We recommend regularly checking the Privacy Policy to stay informed of current rules.
